No need for a probe into judge Loya death: SC

The Supreme Court this morning dismissed a batch of petitions seeking an independent inquiry into the death of special CBI Judge Brijgopal Harkishan Loya, who was hearing the Sohrabuddin Sheikh encounter case.

"Indians are deeply intelligent". The case had involved various police officers and Bharatiya Janata Party (BJP) chief Amit Shah, before his death in December 2014.

BJP Spokesperson Sambit Patra said people who have been politicizing the judiciary for their own motives, now stand exposed.

Mr Surjewala also stressed that the Congress was not among the petitioners seeking a probe into the judge's death and recalled that the party had instead approached the people's court and approached President Ram Nath Kovind along with 14 other opposition parties. Judge Loya died as a result of natural causes.

The BJP's attempt to misinterpret the Supreme Court judgement reflects their jitteriness and frustration. Most Indians, including those in the BJP, instinctively understand the truth about Amit Shah.

"It is a travesty of justice for the resources of the legal system to be consumed by an avalanche of misdirected petitions purportedly filed in the public interest which, upon due scrutiny, are found to promote a personal, business or political agenda".

Justice Chandrachud, writing the judgment for the Bench, said, "We must lean in favour of the version of the four judicial officers unless strong and indisputable circumstances are shown to doubt their credibility". The Manipur CM further maintained that the Congress party has always blamed Prime Minister Narendra Modi and his government for every issue, but the party never blamed their leaders for any the wrong doings when they were in power for the last five to 15 years. Worse still, such petitions pose a grave danger to the credibility of the judicial process. "Congress should now stop politics of rumour mongering", said Pradhan.

During their 12 January press conference, four senior-most apex court judges - J Chelameswar, Ranjan Gogoi, MB Lokur and Kurian Joseph - had questioned the manner in which sensitive cases were being allocated and Loya's case was one of them.
