The lawsuit says this breaches IL state law. In June 2011, Facebook had more than 6m users in IL. In order to do this, Facebook would have to collect users' biometric data to ensure their facial recognition tech would work, triggering privacy concerns.

District judge James Donato has given the go-ahead for a major lawsuit to settle a dispute between the social network and a group of users in IL over the handling of their private data, The Independent reports.

As Techradar put into perspective, there are 36.38 million people who have deleted the mobile app and 19.26 million who have deleted their accounts out of the 214 million total Facebook users in the US.

"While not trivial, BIPA's statutory damages are not enough to incentivize individual plaintiffs given the high costs of pursuing discovery on Facebook's software and code base and Facebook's willingness to litigate the case.Facebook seems to believe that a class action is not superior because statutory damages could amount to billions of dollars", Donato wrote.

The news comes as the social networking giant continues to face scrutiny over its data collection practices in the wake of the Cambridge Analytica scandal, which has seen founder and chief executive Mark Zuckerberg face two days of questioning from USA politicians.

What does the facial recognition do?

One of the features that Facebook introduced to its platform several years ago was the ability to recognize faces in your photos.

The company has altered the controversial feature in the time since it was first rolled out to users back in 2011 by adding a more direct notification alerting users to the facial recognition features.

In December 2017 Facebook announced that users would be notified if a picture of them was uploaded by someone else, even if they hadn't been tagged in it.

According to the report, the information that was accessed by "Bumble" included a person's friends list, relationship status, current location and friends a user had in common with other Bumblers.
