United States puts a hold on H1B plan, relief for Indians

"We are delighted that Indian IT workers will get all their benefits as the U.S. decided not to change any rules in H-1B visa norms". When the reports first became pubic, there was a stir among the Indian's and other people who have been working overseas and who are not the permanent citizens of the state. They were previously on the staff of Senators Jeff Sessions and Charles Grassley respectively, both lawmakers having made fervent legislative efforts to squish H-1B visas.

The change would force all Indians, not holding green card or have applied for a green card, to leave the US.

US President Donald Trump since coming into office has been encouraging a "Buy American, Hire American" tightening the noose on H-1B visas that are issued to foreign workers for a period of 3-6 years, and are sometimes converted into permanent residency permits.

The proposal, in the form of an internal memo that had gone around the Department of Homeland Security (DHS), which oversees USCIS, had set out to end the provision of granting extensions to H-1B visa holders whose applications for permanent residency (Green Card) had been accepted.

The clarification by USCIS will come as a huge relief for hundreds of thousands of H-1B visa holders, and for those visa holders who are now in an advanced stage of their Green Card petitions.

Under the American Competitiveness in the Twenty-First Century Act (AC-21), H-1B visa holders are given extensions of one-year and three-year increments.

McClatchy reports that this reassurance comes after the business community sharply rebuked the potential policy change, though USCIS denies that claim.

The US Citizenship and Immigration Services (USCIS) indicated that there is no end of extensions for H-1B holders. The US government decision, seen as the largest reform after three decades, is expected to add $1.4 trillion (Rs 90 lakh crore) to the Federal deficit over the next decade.

Groups that represent Indian companies and workers - such as the National Association of Software and Services Companies, Immigration Voice and Compete America - started deploying lobbyists and other representatives at both ends of Pennsylvania Avenue to argue against possible regulatory changes that could prevent foreign tech industry workers from keeping their visas longer than six years, according to USA and India-based industry sources and worker advocates familiar with the plans, reported McClatchy.
