  • Federal Judge Blocks Trump's Ban On Transgender Service Members In The Armed Forces

A court rejected President Trump's ban on transgender people serving in the military, essentially reinstating a previous policy that allowed them to serve.

President Trump announced in a series of tweets in July that American forces could not afford the "tremendous medical costs and disruption" of transgender troops, and said "the United States Government will not accept or allow transgender individuals to serve in any capacity in the U.S. Military".

Now, a federal judge has blocked parts of Trump's proposed ban saying that transgender service members who have brought litigation forward against Trump "have established that they will be injured by these directives, due both to the inherent inequality they impose, and the risk of discharge and denial of accession that they engender". "And it means transgender people have to be allowed to enlist in the military".

With Kollar-Kotelly's decision, the military will now "revert to the status quo" in regard to transgender service members-meaning former President Obama's serve-openly policy will live on.

The new administration announced in June a six-month delay on implementing that ruling, then, in July, Trump surprised Pentagon leaders by announcing on Twitter a full ban on transgender people serving "in any capacity". He followed with an August memo directing the Pentagon to extend indefinitely a ban on transgender individuals joining the military, and gave Defense Secretary Jim Mattis six months to come up with a policy on "how to address" those who are now serving.

GLBTQ Legal Advocates & Defenders, or GLAD, issued a statement about the ruling in favor of plaintiffs from their organization and the National Center for Lesbian Rights. The case will still have to be addressed in court to ultimately determine if the ban is unconstitutional.
